Terms and Conditions

Easy VR Technology Limited (the "Company") is an IT company specializing in virtual reality, augmented reality and mixed reality. This usage scope of website and its related mobile applications allow the user to create and distribute the user's owned VR, panoramas and videos. The use of the Easy VR Technology Limited‘s website and mobile applications ("Easy VR") and thereby established business relation between Easy VR and the user shall exclusively be governed by the following terms of use. By subscribing the Service, the Subscriber agrees to be bound by these terms and conditions.

You may not become a subscriber if you are under the age of 13. Easy VR's website and applications are not intended for children under 13 and the Company will not knowingly collect personal information from children under the age of 13.

By granting your child permission to use the Easy VR's Service, you agree to the terms of this Agreement on behalf of your child. You are responsible for monitoring and supervising your child's use of the Company Service. If your child is using the Company Service and is either under 13 or does not have your permission, please contact us immediately so that we can disable his or her access.

1. License to Use the Easy VR Service

The Company grants you a limited, non-exclusive license to access and use the Easy VR Service for your own personal, non-commercial purposes. This includes the right to view content available on the Easy VR Service. This license is personal to you and may not be assigned or sublicensed to anyone else. You may not use the Easy VR Service for commercial purposes unless:

You are an Easy VR PRO or higher subscriber, in which case you may use and access the Easy VR Service for commercial and non-commercial purpose; or You are a small-scale independent production company, non-profit, or artist, in which case you may use the Easy VR Service to showcase or promote your own creative works. If you sell EasyVR-hosted videos directly to users other than through EasyVR On Demand, such usage will be deemed an "Application" under this term.

Except as expressly permitted by the Company in writing, you will not scrape, reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble the Easy VR Service or any source code therein. Nor will you attempt to circumvent any of the Company's technical measures or take any measures to interfere with or damage the Company Service. All rights not expressly granted by the Company are reserved.

2. Subscriptions

The Subscriber must:
(a) only use the Data or any other material accessed through the Service for the Subscriber's personal use and not use the Service on behalf of, or to provide services to, a third party; and
(b) keep the Subscriber's password to the Service secure. When you complete Easy VR's registration process, you create an Easy VR account ("Account"). Your Account may also include billing information you provide to Easy VR for the purchase of Subscriptions, Content and Services. You may not reveal, share or otherwise allow others to use your password or Account except as otherwise specifically authorized by the Company. You are responsible for the confidentiality of your login and password and for the security of your computer system. The Company is not responsible for the use of your password and Account or for all of the communication and activity on Easy VR that results from use of your login name and password by you, by any person to whom you may have intentionally or by negligence disclosed your login and/or password in violation of this confidentiality provision. Unless it results from the Company's negligence or fault, the Company is not responsible for the use of your Account by a person who fraudulently used your login and password without your permission. If you believe that the confidentiality of your login and/or password may have been compromised, you must notify the Company via the support form without any delay.

Your Account, including any information pertaining to it (e.g.: contact information, billing information, Account history and Subscriptions, etc.), is strictly personal. You may therefore not sell or charge others for the right to use your Account, or otherwise transfer your Account, nor may you sell, charge others for the right to use, or transfer any Subscriptions other than if and as expressly permitted by this Agreement (including any Subscription Terms or Rules of Use) or as otherwise specifically permitted by the Company.

The Subscriber acknowledges nothing in this agreement is intended to give the Subscriber any Intellectual Property Rights in material accessed through the Service or any other Intellectual Property Rights of Subscriber.

The Subscriber acknowledges and agrees that:
(a) the Data and Service may not be error free, and Easy VR makes no representation and gives no warranty that the Service will contain any particular data, function in any particular way or be available at any particular time; and
(b) the Service may not be available from time to time.

The Subscriber authorises the Company to monitor the Subscriber's use of the Service and to use information relating to the Subscriber's use of the Service to market products or services to the Subscriber.

The Subscriber must ensure that all information entered by the Subscriber into the Service is complete and accurate at all times during the Term.

The Subscriber acknowledges that the Company is relying on the completeness and accuracy of the Subscriber Material, and if the Subscriber does not provide complete and accurate Subscriber Material, Easy VR may be unable to provide the Service.

The Subscriber must retain a copy of all data relating to the Subscriber stored through the Service, so that all such data can be recovered by the Subscriber if that data can no longer be accessed through the Service.

3. Purchases

In addition to offering Basic (free) Easy VR memberships, we offer paid subscriptions. Please see our pricing pages for current features and pricing. Payment processing related to Content and Services purchased on Easy VR's website or its related mobile application is performed by The Company. For any other type of purchases, payment will be collected by the Company directly. Features and prices are subject to change. Storage limits are calculated based upon source files. We reserve the right to charge for excessive use of bandwidth where plays occur on third-party sites and applications outside the native Easy VR player or apps. Anyone who wishes to obtain storage capacity beyond what is offered with a particular subscription, or additional bandwidth for applications not using the Easy VR player may request a custom account by contacting us. Additional terms and conditions (to be shown prior to purchase) apply to custom accounts. All fees may be subject to taxes.

Subject to the terms hereof, you may choose to renew your subscription at the end of the subscription period. By default, all subscriptions are set to automatically renew for the same period of time as the original subscription. You may decline to renew at any time prior to the commencement of a renewal subscription. The Company reserves the right to deny subscriptions, renewals, and other purchases for any reason. Unused storage, plays, and other limits do not roll over to subsequent subscription periods.

When a paid subscription ends, the account automatically becomes a Basic (free) account and the Company may disable access to or delete any content to comply with Basic account limits. If you're using Easy VR for commercial purposes, you will need to maintain an Easy VR PRO or higher plan to continue hosting your videos. Your account and its content may be deleted if your subscription is not renewed.

If you are a PRO or Business subscriber, you may grant access to our shooting services. You are responsible to contact us actively within the subscription period and reserve a reasonable time slot by 20 working days ago with us. You should pay the transportation fee to our crew. The shooting services should be performed within Hong Kong. If you are an Easy VR member who has been granted access to a PRO or Business account, you must comply with the terms of this Agreement in accessing that account.

4. Code of Conduct

The following rules are mandatory and apply to the conduct of all users, to the content of all profiles, to all panoramas and videos as well as to all dealings with data that are accessible on to website. All users shall maintain a respectful manner of expression and polite interaction. No one shall be negatively emphasized, defamed, harassed, insulted or ridiculed. Further, you will NOT:

• Show pornographic motifs and images of physical or sexual violence
• Show contents of victims of violent acts, war and natural catastrophes, the usage of unconstitutional symbols as well as the illustration of motifs that glorify violence or acts of war;
• Show contents that contravene human dignity, in particular the illustration of humans who are or have been dying or suffering from serious physical or psychological illness are inadmissible
• Show infringes any third party's copyrights or other rights (e.g., trademark, privacy rights, etc.);
• Show hateful, defamatory, or discriminatory content or incites hatred against any individual or group;
• Promote fraudulent or dubious business schemes;
• Violate any law;
• Act in a deceptive manner by, among other things, impersonating any person;
• Harass or stalk any other person;
• Harm or exploit minors;
• Distribute "spam";
• Collect information about others; or
• Advertise or solicit others to purchase any product or service within the Easy VR Site (unless you are an official the Company partner or advertiser and have a written agreement with the Company).

The Company has the right, but not the obligation, to monitor all conduct on and content submitted to the Company Service. Any violation of the terms of use or the rules of this code of conduct result in a warning of the user, a temporary or permanent blocking or deletion of the user account. The Company reserves the right to delete any account immediately and without any warning.

5. Disclaimers

The Company reserves the right to modify the Easy VR Service. You are responsible for providing your own access (e.g., computer, mobile device, Internet connection, etc.) to the Easy VR Service. The Company has no obligation to screen or monitor any content and does not guarantee that any content available on the Easy Service complies with this Agreement or is suitable for all users.

The Company provides the Easy VR Service on an "as is" and "as available" basis. You therefore use the Easy VR Service at your own risk. The Company expressly disclaims any and all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty that might arise under any law.
